Aboriginal magistrate PAT O'SHANE says GEOFF CLARK's suspension as ATSIC chairman isa splendid distraction from allegations that Prime Minister JOHN HOWARD misled parliament.

The government suspended Mr CLARK yesterday for misbehaviour as Mr HOWARD came underopposition fire for a third day for allegedly misleading parliament about his dealingswith ethanol producer DICK HONAN.

The outspoken Sydney magistrate has questioned Indigenous Affairs Minister PHILIP RUDDOCK'Sauthority to suspend ATSIC's first democratically elected leader over his conviction inVictoria over a pub brawl.

Ms O'SHANE has told ABC radio that the matter is under appeal and therefore the minister'sauthority to suspend Mr CLARK is questionable.
